Interim terms, version buyer-acceptance-2026-09-26, effective 2026-09-26. These terms are in force now and are under legal review. We will give notice of changes as set out in clause 16 of the Terms of Service.
Buyer Acceptance
You are about to accept a Seller's Licence through Elbereth. The Listing, the Seller, the Licence version and its SHA-256 hash, and the Purpose you choose are shown with this text. So is where the data is held: for a Link Listing you will receive the Seller's own download address; for a Hosted Listing you will download from us.
By selecting Accept (or sending the acceptance through the API), you confirm, for the organisation you represent, the following:
- You accept the Seller's Licence shown below, at that version, for the Purpose you chose only. The Licence is between you and the Seller; Elbereth is not a party to it. If the Seller changes the Licence, you must accept the new version before accessing the data again through Elbereth.
You have read the Labels, and the choice is yours.
- The consent, RTB, jurisdiction, retention and link-health Labels are shown so that you can decide.
- On a Link Listing they are the Seller's own statements, and Elbereth has not verified them.
- You are responsible for deciding whether you may lawfully use this data for your Purpose.
You are not a covered person or a sanctioned party.
- You are not a Covered Person under 28 CFR Part 202.
- You are not organised in, based in, or 50% or more owned from a Country of Concern.
- You are not listed on, owned or controlled by, or acting for anyone on, the Australian Consolidated List or the OFAC SDN List.
Elbereth does not check sanctions lists; it relies on this statement.
- You will not pass the data on to them. You will not sell, license or give access to this data to a Country of Concern or a Covered Person, and you will not engage in any other data brokerage of it with them.
- You will honour deletions. If the Seller or Elbereth tells you that a data subject has asked for their data to be deleted, you will delete it from your copies within 30 days, or sooner if the law requires, and confirm when asked.
- You will not use the data to single out people. You will not use this data to identify, track, score or target individuals, or to infer health, religion, politics or sexuality. That applies unless the Licence expressly permits the use and the law allows it.
- If the Listing is priced, you pay first. You will be sent to Stripe Checkout. Your acceptance is recorded only when the payment completes. One payment buys this one acceptance: this Licence version, for this Purpose. The Service does not bill again on a schedule, but a new Licence version needs a new acceptance and a new payment.
Elbereth records this acceptance as evidence.
- The record holds: your organisation, the API key that accepted, the Purpose, the Licence version and hash, the version and hash of this text and of the Terms of Service, and the time.
- It is kept in a tamper-evident, append-only record that cannot be edited.
- The Seller can see it. Each time you receive the Seller's address, download data or run an Add-on on this data, that is recorded too, including your filters and parameters and a hash of what we served. The Seller can see those records.
- Elbereth may use these records to enforce its terms, to answer regulators and lawful requests, and in disputes. See the Privacy Policy at

- The Elbereth Terms of Service apply to your use of Elbereth, at the version in force when you accept (
/catalog/legal/terms).
